Zoning & covenants
City RS-1 zoning and recorded private covenants both apply.
City of Moundville — RS-1 zoning
RS-1 is the City's low-density single-family residential district. It sets baseline rules for permitted uses, setbacks, building height and lot coverage, and is the floor — not the ceiling — for what is allowed.
Cherokee Bend covenants (private)
The Cherokee Bend Protective & Restrictive Covenants (recorded December 10, 2004 as Instrument 2004/27333, Tuscaloosa County Probate) are private deed restrictions that run with the land. They cover home size, building materials, architectural approval, animals, vehicles, signs, fences and more. Where zoning and covenants conflict, the more restrictive standard controls.
Estate Home classification
Lots of 1.5 acres or more are Estate class under the covenants. Homes must face the street (corner lots may face either street), be limited to two stories and include a private garage for at least two cars.
- Minimum home size2,000 sq ft interior (excluding porches, garages and carports), minimum two baths
- Side setbacks10 ft from interior lot lines
- Rear setback20 ft from the back lot line
- HOA dues$250 per year per lot (initial recorded amount for Estate-class lots)
03
Architectural approval
Submit in writing, wait 30 days, build to standard.
Written Architectural Control Committee (ACC) approval is required before building a home or adding fences, outbuildings, pools, mailboxes, satellite dishes or other exterior changes.
- 01Submit in writingSend plans and specifications in writing through the HOA's management company, Spaces Management. Keep proof of the submission date.
- 02Wait 30 daysUnder Section 6 of the covenants, if the Committee does not approve or disapprove within 30 days after plans are submitted, approval is not required and the related covenants are deemed complied with.
- 03Build to covenant standardsWhether approved or deemed approved, build to the covenant standards and keep all records of your submission.
04
Homeowners association
Membership is mandatory for every lot owner.
Every lot owner is automatically a member of the Cherokee Bend Homeowners Association, which maintains the entrance and common areas and carries liability insurance on them. Dues are set each September and become delinquent December 1. Delinquent accounts accrue 1.5% interest per month, and unpaid assessments become a lien on the lot — confirm the current dues amount and account status before closing.
